1. Acceptance of Terms

By accessing or using inKakaʻako (the “Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you should not use the Site.

2. Description of Service

inKakaʻako is a digital lifestyle and real estate information platform focused on the people, places, neighborhoods, and residential opportunities shaping Kakaʻako and urban Honolulu. The Site provides neighborhood content, real estate information, and opportunities to submit inquiries related to residential developments and housing programs.

Real estate inquiries submitted through inKakaʻako are handled by ONE Pacific Realty, Inc., a Hawaiʻi real estate brokerage. Any real estate services, advice, or representation are provided by ONE Pacific Realty, Inc. under its own agreements and policies.

3. Eligibility

You must be at least 18 years old and capable of entering into a binding agreement to use the Site and submit inquiries. By using the Site, you represent and warrant that you meet these requirements.

4. Use of Content

All content provided on inKakaʻako, including text, images, graphics, and other materials, is for informational purposes only.

You may view, share, or reference content for personal, non-commercial use, provided you do not remove any copyright or attribution notices.

Content may not be reproduced, distributed, modified, or used for commercial purposes without prior written permission from inKakaʻako or the applicable rights holder.

5. No Legal, Financial, or Tax Advice

The information on the Site is provided for general informational purposes and does not constitute legal, financial, tax, or other professional advice.

You should consult with appropriate professionals before making decisions related to real estate, financing, taxes, or legal matters.

6. Real Estate and Reserved Housing Information

Information about residential developments, Reserved Housing programs, eligibility requirements, financing, and application procedures is provided as a general overview only.

Submitting an inquiry or joining an interest list through the Site does not:

  • Constitute an official application for a Reserved Housing program.
  • Establish eligibility for any housing program.
  • Guarantee lottery participation, unit availability, or purchase eligibility.
  • Establish a real estate agency relationship or buyer representation agreement.

Official requirements, deadlines, availability, and program procedures are determined by the applicable developer, administering agency, and/or brokerage and are subject to their published materials and agreements.

7. User Conduct

You agree to use the Site for lawful purposes only and not to:

  • Submit false, misleading, or fraudulent information.
  • Interfere with or disrupt the operation of the Site.
  • Attempt to gain unauthorized access to any systems, data, or user information.
  • Use the Site in a way that infringes on the rights of others or violates applicable laws or regulations.

We reserve the right to restrict or terminate access to the Site for users who violate these Terms or engage in abusive or unlawful behavior.

8. Third-Party Services and Links

The Site may reference or link to third-party websites, platforms, or services, including but not limited to real estate tools, mortgage resources, or external content.

These third-party sites and services are not controlled by inKakaʻako, and we are not responsible for their content, policies, or practices.

Your use of third-party sites or services is at your own risk and may be subject to separate terms and privacy policies.

9. Disclaimer of Warranties

The Site and its content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.

To the fullest extent permitted by law, inKakaʻako and ONE Pacific Realty, Inc. disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free from viruses or other harmful components, or that any information provided is complete, accurate, or current.

10. Limitation of Liability

To the fullest extent permitted by law, inKakaʻako, ONE Pacific Realty, Inc., and their respective owners, agents, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site or reliance on its content.

In no event shall the total liability of inKakaʻako or ONE Pacific Realty, Inc. for any claim related to the Site exceed the amount, if any, paid by you directly to inKakaʻako for use of the Site.

11. Indemnification

You agree to indemnify, defend, and hold harmless inKakaʻako, ONE Pacific Realty, Inc., and their respective owners, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Site.
  • Your violation of these Terms.
  • Your violation of any rights of a third party.
12. Changes to the Site and Terms

We may update, modify, or discontinue any part of the Site at any time without prior notice.

We may also update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page.

Your continued use of the Site after changes to the Terms are posted constitutes your acceptance of the updated Terms.

13. Governing Law and Contact Information

These Terms are governed by and construed in accordance with the laws of the State of Hawaiʻi, without regard to its conflict of law principles.
